Terms & Conditions

Last updated: 7 October 2026

1. About these terms

These Terms and Conditions apply to all IT, computer, network, web design, consulting and related services and products supplied by Ulrich Wallrodt trading as Tekwizard (ABN 43 006 508 486), 20 Garden Ave, Mullumbimby NSW 2482 (“Tekwizard”, “we”, “us”, “our”). “You” means the person or business we supply services or products to.

By asking us to carry out work, accepting a quote, or leaving equipment with us, you agree to these terms. Web hosting and domain names are supplied under our separate Web Hosting Terms and Conditions.

2. Quotes and estimates

A quote is a fixed price for the work described in it and is valid for 30 days unless stated otherwise. An estimate is our best guess of the likely cost and is not a fixed price. If it becomes clear that the work will cost significantly more than estimated, we will contact you before continuing.

Work outside the scope of a quote (for example extra features or changes you request) is charged at our hourly rate unless we agree otherwise.

3. Fees and charges

Unless a fixed quote applies, labour is charged at our current hourly rate, subject to a minimum charge. On-site visits also incur a call-out fee. Our current rates are available on request and will be confirmed before work starts. Parts, hardware and software are charged at the price quoted to you.

Tekwizard is not registered for GST. No GST is included in or charged on our prices.

If you cancel or reschedule an on-site appointment with less than 24 hours’ notice, or we cannot access the site at the agreed time, we may charge the call-out fee.

4. Payment

Invoices are due within 14 days of the invoice date. If an invoice is overdue, we may stop or postpone further work until it is paid. Ownership of hardware we supply, and of website work we create for you, passes to you once it has been paid for in full.

5. Your data and backups

Computers, phones and storage devices can fail at any time, including during repairs, upgrades and data transfers. Before any work starts, you are responsible for making sure your important data is backed up, unless you have asked us to do the backup as part of the job. We take reasonable care with your data, but, subject to section 14, we are not responsible for data loss that a current backup would have prevented.

We access your files, accounts and devices only as needed to do the work, and we keep any information we see confidential. If you give us passwords to do the work, we recommend you change them once the job is complete.

6. Software and licences

You must hold valid licences for all software on your equipment and any software you ask us to install. We do not install pirated or unlicensed software. You are responsible for any subscription, licence or renewal fees charged by software vendors.

7. Hardware supply

New hardware we supply comes with the manufacturer’s warranty, as well as the guarantees under the Australian Consumer Law (see section 14). Warranty claims are handled under the manufacturer’s process, and we will help you with them. We do not accept returns of correctly supplied items for change of mind, including items ordered specifically for you.

8. Repairs and equipment left with us

Diagnosing a fault takes time, so diagnostic work is charged even if the equipment cannot be repaired or you decide not to go ahead. We will contact you with the likely cost before carrying out repairs beyond what you have approved.

When your equipment is ready, we will let you know. Please collect it within 30 days. If equipment is not collected after we have given you notice, we may deal with it, including selling or disposing of it, in accordance with the Uncollected Goods Act 1995 (NSW), and may recover our unpaid charges and reasonable storage costs from any sale proceeds.

9. Data recovery

Data recovery from faulty or damaged devices is not always possible, and we cannot guarantee that any data can be recovered. Data recovery work is charged as quoted or at our hourly rate, whether or not the data can be recovered, unless we agree otherwise in writing.

10. Web design and development

  • Scope: We will build your website as described in our quote. Changes or additions outside that scope are charged at our hourly rate.
  • Your content and copyright: You are responsible for supplying text, images, logos, videos, music, fonts and other content for your website. You are solely responsible for making sure you own, or have permission to use, all content on your website, including content you supply, content you ask us to use (for example images found online), and content you approve before the site goes live. We do not check whether content is free of copyright, trade mark or other restrictions. You are responsible for any infringement claims, licence fees, fines or removal requests relating to your website’s content, and you agree to indemnify us against any claims, losses and costs (including reasonable legal costs) arising from them. If we receive a credible infringement complaint, we may remove or disable the content concerned.
  • Ownership: Once paid in full, you own your website’s content and the design work created specifically for you. Themes, plugins, fonts and other third-party components remain subject to their own licences. We may list your website in our portfolio unless you ask us not to.
  • Search engine optimisation: We use recognised SEO practices, but search rankings are controlled by search engines and cannot be guaranteed.
  • After launch: Unless you have a maintenance plan with us, you are responsible for keeping your website software, themes and plugins up to date after the site is handed over. Any further work is charged at our hourly rate.

11. Internet, NBN, Starlink and network services

We can set up, troubleshoot and negotiate on your behalf, but internet services are supplied by third parties (such as your internet service provider, NBN Co or Starlink). We are not responsible for their availability, speed, outages, fees or contract terms. Installations on your property are carried out with your permission. We may decline or postpone work we consider unsafe, such as roof installations in poor weather.

12. Advice and consulting

Our advice and recommendations are based on the information you give us and on the products and services available at the time. Decisions about purchases and how to run your systems remain yours.

13. Privacy

We collect your personal information only to provide our services, invoice you and contact you about your work. We do not sell your personal information. We share it only as needed to provide our services (for example with suppliers, internet providers or manufacturers for warranty claims) or where required by law.

14. Australian Consumer Law and limitation of liability

Our services and products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these terms excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot be excluded.

To the extent permitted by law, and where our services or products are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to comply with a consumer guarantee is limited, at our option, to supplying the services again or paying the cost of having them supplied again, or to repairing or replacing the goods or paying the cost of doing so.

Subject to the paragraphs above, and to the extent permitted by law:

  • we are not liable for any indirect or consequential loss, including loss of profits, revenue, business, data or goodwill; and
  • our total liability to you for any job is limited to the amount you paid us for that job.

15. Changes to these terms

We may update these terms from time to time. The version on this page at the time you engage us for a job applies to that job.

16. General

  • Events outside our control: We are not responsible for delays caused by events beyond our reasonable control, such as supplier delays, natural disasters or power and network failures.
  • Severability: If any part of these terms is invalid or unenforceable, it will be read down or removed to the minimum extent necessary, and the rest of these terms will continue to apply.
  • Disputes: If a dispute arises, please contact us first so we can try to resolve it informally.
  • Governing law: These terms are governed by the laws of New South Wales, Australia, and both parties submit to the jurisdiction of the courts of New South Wales.
